HeySnow is a software developed by Beijing FenXue Technology Co., Ltd. ("FenXue Technology"). In order to use HeySnow (the "Software") and the Services, you should read and comply with the Service Agreement (the "Agreement").
Please be sure to read and fully understand the terms and conditions, especially the terms that exclude or limit liability, the terms of jurisdiction and application of law, and the agreement to start or use a particular service. You are not authorized to download, install or use the Software and related services unless you have read and accepted all of the terms of this Agreement. By downloading, installing, using, acquiring a HeySnow account or logging in, you are deemed to have read and agreed to be bound by this Agreement. If you are under the age of 18, please read this Agreement under the supervision of your legal guardian, and pay special attention to the terms of use by minors.
This Agreement is an agreement between you and FenXue Technology regarding your downloading, installation, use, and reproduction of the Software, and the use of FenXue Technology related software and services. The term "FenXue Technology" refers to Beijing FenXue Technology Co., Ltd. and its related services that may exist in the operation of affiliated units. The term "User" refers to the user of the relevant services of FenXue Technology, more commonly referred to as "You" in this Agreement.
The Content refers to the mobile platform App (i.e. "HeySnow") provided by FenXue Technology to users, which supports single and multi-person interaction and provides products and services including but not limited to track records, instant communication between users, information dissemination between users, network media, Internet value-added, interactive entertainment, e-commerce and advertising on the basis of geographic location-based services (the "Services"). You may obtain the Software directly from FenXue's website or from a third party authorized by FenXue. If you obtain the Software or an installer with the same name as the Software from a third party that is not authorized by FenXue Technology, FenXue Technology cannot guarantee that the Software will work properly and will not be responsible for any damage caused to you as a result.
You are required to download the HeySnow Client to use the Services, for which FenXue Technology grants you a personal, non-transferable and non-exclusive license to use your cell phone number, or WeChat, Weibo, QQ as your user name when logging in to the HeySnow Software, and you may use the Software and services only for the purpose of accessing or using the Services. The HeySnow Client provide several application versions including but not limited to iOS, Android, Windows Phone, Symbian, BlackBerry, Windows, Mac, etc. The user must select the Software version that matches his/her installed terminal device. In order to provide services of more quality and security, FenXue Technology may recommend you to install other software during the installation of this software, and you can make your own decisions.
You may make a copy of the Software for the purpose of using the Software and services for backup purposes only. The backup copy must contain all copyright information contained in the original Software. All other rights not expressly authorized in this section and elsewhere in this Agreement shall remain reserved by FenXue Technology, and you must obtain separate written permission from FenXue Technology to exercise such rights. The failure of FenXue Technology to exercise any of the foregoing rights does not constitute a waiver of such rights.
In order to benefit the user and improve the service content, FenXue Technology will constantly strive to develop new services and provide you with occasional software updates (these updates may take the form of software replacements, modifications, functional enhancements, version upgrades, etc.). In order to ensure the security and functional consistency of this software and services, FenXue Technology reserves the right to update the Software without notice, or to change or limit some functions and effects of the Software. After the release of a new version of this software, the old version of the Software may not be available. FenXue Technology does not guarantee that the old version of the Software and the corresponding customer services continue to be available, please check and download the latest version from time to time.
3.1 The protection of users' personal information is a basic principle of FenXue Technology, and FenXue Technology will take reasonable measures to protect it. Except for the circumstances stipulated by laws and regulations, FenXue Technology will not disclose or reveal the user's personal information to third parties without the permission of the user. FenXue Technology adopts professional encrypted storage and transmission methods for related information to ensure the safety of users' personal information.
3.2 You need to provide some necessary information in the process of registering an account or using this Service, for example, in order to provide you with account registration services or user identification, you need to fill in your cell phone number; The People Nearby function requires your consent to use the geographic location information; the Contacts Matching function requires your authorization to the access of your Contacts, etc.. If there are special provisions in national laws and regulations or policies, you need to provide true and correct identity information. If the information you provide is incomplete, you will not be able to use the Service or will be restricted in the process of using it.
3.3 In general, you can browse and modify the information you submit at any time, while for security and identification considerations (such as account appeal service), you may not be able to modify the initial registration information and other verification information provided at the time of registration.
3.4 FenXue Technology will apply various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use or disclosure.
3.5 FenXue Technology will not disclose your personal information to any company, organization or individual outside of FenXue Technology without your consent, except as otherwise provided by laws and regulations.
3.6 FenXue Technology attaches great importance to the protection of personal information of minors. If you are a minor (under the age of 18), you should obtain the prior written consent of your parent or legal guardian ("Guardian") before using the Services of FenXue Technology.
3.7 FenXue may share your information with other users of HeySnow to facilitate them to provide you with the relevant services you applied for, for example, we may share your nickname, photo (in case of provide), image (in case of provide), user rating and other information with one or more of the people you are about to skate with.
3.8 You are required to register an account to use the Services of FenXue Technology or HeySnow. Technology specifically reminds you that you should keep your account and password properly. When you finish using HeySnow , you should log out safely. It’s your sole and separate responsibility for the theft of your account or password caused by your improper safekeeping.
1. HeySnow account can be registered through cell phone number or AppleID, Google+, Facebook. After successful registration of third-party account, it is necessary to bind your mobile phone number. FenXue Technology has the right to change the way of account registration and binding ways according to user needs or product needs. For the specific rules of your account use, please comply with the national laws and regulations, relevant Account Use Agreements and special rules issued by FenXue Technology for this purpose. The ownership of HeySnow account belongs to Fenxue Technology Co., Ltd. After completing the registration application procedures, the user will only be granted the right to use the HeySnow account, and this right belongs to the initial registrant only. At the same time, the initial registrant shall not give, borrow, rent, transfer or sell the HeySnow account or otherwise allow the non-initial registrant to use the HeySnow account. The non-initial registrant may not use the HeySnow account by gift, inheritance, lease, assignment or any other means.
2. The user is responsible for the security of the registered account information and the account password, and the user is legally responsible for the behavior under the registered account and password. The user agrees not to disclose account and password information to others under any circumstances. When in your suspect that others are using your account, you should immediately notify FenXue Technology.
3. You understand and agree that, in order to provide you with effective service, the Software will utilize resources such as processor and bandwidth of your terminal device. The Software may require data access during the use process, the user need to consult the relevant charges from the operator themselves, and bear the relevant costs. Some functions of the Software may disclose the user's information to third parties , for example, query the user's avatar, nickname and other public personal data; if you register your HeySnow account with your cell phone number or your cell phone number is associated with your HeySnow account, your HeySnow account can be queried by your friends who have that number in their Contacts; the content of comments, uploaded pictures and videos of registered users can be viewed by users who have the corresponding functional authority in the Client.
4. You understand and agree that FenXue Technology will make every commercially reasonable effort to ensure the safety of your data storage in the Software and services, however, FenXue Technology can not provide full guarantee, including but not limited to the following circumstances: FenXue Technology is not responsible for the deletion or storage failure of your relevant data in the Software and services; FenXue Technology has the right to determine the maximum storage period of individual user data in the Software and services according to the actual situation. The maximum storage period of data in the Software and services for a single user is determined by FenXue Technology at its discretion, and the maximum storage space is allocated for the data on the server, etc. You can back up the relevant data in the Software and services by yourself according to your own needs; if you stop using the Software and services or the Services are terminated or cancelled, FenXue Technology can permanently delete your data from the server. After the service are stopped, terminated or cancelled, FenXue Technology has no obligation to return any data to you.
5. When using this software and service, the user shall bear the following risks beyond the control of FenXue Technology, including but not limited to: risks such as loss and leakage of personal information caused by force majeure factors; the user must choose and installed terminal equipment to match the Software version, otherwise, any problems or damages caused by the mismatch between the Software and the terminal equipment model shall be borne by the user himself; the user is responsible for the risks that may be caused by the third-party website and related contents when he/she visits the third-party website using the Software; the risks and responsibilities that may be caused by the dissemination of the content submitted by the user that is forwarded or shared by others; the risks of login failure, incomplete data synchronization and slow page opening due to unstable wireless network signal, narrow wireless network bandwidth, etc. .
6. When you use the products or services provided by the third party of the Software, you should also comply with the third party's user agreement in addition to this Agreement. FenXue Technology and the third party shall bear their respective responsibilities for possible disputes within the scope stipulated and agreed by law. As users use the Software or request specific services from FenXue Technology, the Software may call third-party systems or support users' use or access through third parties, and the results of the use or access will be provided by such third parties (including but not limited to services provided by third parties through HeySnow accounts, or content accessed through open platforms, etc.), FenXue Technology does not guarantee the safety, accuracy, effectiveness and other uncertain risks of providing services and contents through third parties, and any disputes and damages arising therefrom, are not related to HeySnow Technology, and HeySnow Technology shall not assume any responsibility.
7. You understand and agree that FenXue Technology has the right to decide to use the Software for commercial purposes, including but not limited to the development and use of some of the Services of the Software for the promotion of third parties, etc. FenXue Technology promises to protect your personal information in the promotion process in strict accordance with this Agreement, and you can also choose to block and refuse to receive relevant promotional information according to the system settings.
8. Information content specification: The information content mentioned in this article refers to any content produced, copied, published and disseminated by users in the process of using the Software and services, including but not limited to HeySnow account avatar, name, user description and other registration information, or text, video, pictures and other sending, replies, graphics and related links page, as well as other content generated by using HeySnow account or the Software and services. You understand and agree that HeySnow has always been committed to providing users with a civilized, healthy and regulated online environment. You shall not use your HeySnow account or the Software and services to create, copy, publish or transmit the following contents that interfere with the normal operation of HeySnow and infringe upon the legitimate rights and interests of other users or third parties, including but not limited to:
1) publishing, transmitting, distributing, or storing content that violates national laws and regulations that prohibit such content;
2) publishing, transmitting, spreading, or storing content that infringes on the legal rights of others, such as reputation, portrait rights, intellectual property rights, and trade secrets;
3) involving the privacy, personal information or information of others;
4) other information that violates laws, regulations, policies and public order and morality, social morality or interferes with the normal operation of HeySnow and violates the legitimate rights and interests of other users or third parties content;
9. Unless permitted by law or written permission from FenXue Technology, you may not engage in the following acts in the course of using the Software:
1) remove the information on the copyright of this software and its copies;
2) reverse engineering, reverse assembly, reverse compilation of the Software, or otherwise attempt to discover the source code of the Software;
3) the content of the intellectual property rights owned by FenXue Technology to use, rent, lend, copy, modify, link, reproduce, compile, publish, publish, establish a mirror site, etc.;
4) the data released into the memory of any terminal in the Software or in the process of running the Software, the interactive data between the Client and the server in the process of running the Software, as well as the system data necessary for the operation of this software to copy, modify, add, delete, hook and run or create any derivative works, including but not limited to the use of plug-ins, cheating programs or non-FenXue Technology authorized third-party tools/services to access the Software and related systems;
5) by modifying or falsifying the instructions and data in the operation of the Software, to add, delete, change the function or operation effect of the Software, or operate or disseminate the Software or methods used for the above purposes to the public, regardless of whether these acts are for commercial purposes or not;
6) login or use HeySnow software and services through third-party software, plug-ins, cheating programs and systems that are not developed or authorized by FenXue Technology, or produce, publish or disseminate the above tools;
7) interfering the software and its components, modules and data by oneself or authorizing others and third-party software;
8) other acts without the express authorization of FenXue Technology.
10. Unless permitted by law or written permission from FenXue Technology, you shall not engage in the following acts in the course of using the Service;
1) submitting or publishing false information, or impersonating or using the name of others;
2) inducing other users to click on the link page or share information;
3) falsifying facts or concealing the truth in order to mislead or deceive others;
4) infringing on the reputation, portrait rights, intellectual property rights, trade secrets and other legal rights of others;
5) using HeySnow account and any function without written permission from FenXue Technology, as well as third-party operating platforms to promote or promote each other.
6) using HeySnow account or the Software and services to engage in any illegal and criminal activities.
7) producing or publishing methods or tools related to the above acts, or operating or spreading such methods or tools, regardless of whether these acts are for commercial purposes or not.
8) other violations of laws and regulations, infringement of the legitimate rights and interests of other users, interference with the normal operation of the product or FenXue Technology is not expressly authorized.
11. You fully understand and agree that you must be responsible for all actions under your registered account, including any content you publish and any consequences arising therefrom. You should judge the content in the Service by yourself and bear all the risks arising from the use of the content, including the risk arising from the reliance on the correctness, completeness or usefulness of the content. FenXue Technology cannot and will not be liable for any loss or damage arising from the foregoing risks.
12. If FenXue Technology finds or receives reports or complaints from others that the user has violated this Agreement, FenXue Technology has the right to delete or block the relevant content at any time without notice, and depending on the circumstances of the act, the offending account is subject to penalties including, but not limited to, warnings, restrictions or prohibitions on the use of some or all of the functions, account blocking until the cancellation, and the announcement of the results of the treatment.
13. You understand and agree that FenXue Technology has the right to punish the violation of the relevant laws and regulations or the provisions of this agreement in accordance with reasonable judgment, to take appropriate legal action against any user who violates the law, and according to the laws and regulations to save the relevant information to the relevant departments to report, etc., the user shall bear all the legal responsibility arising therefrom alone.
14. You understand and agree that you shall be solely responsible for any claims, demands or losses claimed by third parties caused or arising from your violation of the provisions of this Agreement or related Terms of Service, and you should compensate FenXue Technology if FenXue Technology suffers any losses.
1. FenXue technology is the intellectual property rights of this software. All copyright, trademark rights, patent rights, trade secrets and other intellectual property rights of the Software, as well as all information content related to the Software (including but not limited to text, pictures, audio, video, charts, interface design, layout frame, relevant data or electronic documents, etc.) are protected by the laws and regulations of the People's Republic of China and the corresponding international treaties. The copyright or trademark rights of the commercial logos such as "FenXue Technology" and "HeySnow" used by FenXue Technology in this service belong to FenXue Technolog.
2. All photos or videos in HeySnow software, whether uploaded and provided by FenXue Technology or uploaded and provided by users, shall not infringe any other third party's patent, copyright, trademark, reputation, portrait, privacy, property rights or any other legal rights and interests. The copyright of the image belongs to the person who took it, and the portrait right of the natural person who is the subject of the photo belongs to the individual who was taken. The user has the right to propose the deletion of the uploaded photo works. Upon receipt of the submitted deletion application, HeySnow will delete the corresponding works displayed on HeySnow within a reasonable period of time.
3. No organization or individual may use the photo or video for commercial purposes without the permission of HeySnow or the person being filmed. In the process of using the pictures or videos, the user shall not violate the portrait rights of others or violate the relevant national laws and regulations. It is strictly prohibited to use the picture or video for purposes that endanger society, the state, or others.
1. You understand and agree that the Software, like most Internet software, may be affected by a variety of factors, including but not limited to user reasons, network service quality, social environment, etc.; it may also be subject to various security issues, including but not limited to the illegal use of user information by others for realistic harassment; other software downloaded and installed by the user or other websites visited may contain viruses, Trojan horse programs or other malicious programs that threaten your terminal device information and data security, and then affect the normal use of the Software, etc. Therefore, you should be aware of information security and personal information protection, pay attention to password protection to avoid losses.
2. You shall not create, publish, use or spread malicious programs used to steal HeySnow account and other people's personal information and property.
3. Maintenance of software security and normal use is the joint responsibility of HeySnow Technology and you, HeySnow Technology will take the necessary technical measures to protect your terminal device information and data security in accordance with industry standards in a reasonable and prudent manner, but you acknowledge and agree that HeySnow Technology does not provide complete assurance in this regard.
4. Under no circumstances should you trust anybody to borrow money, ask for passwords or other network information related to property. If you are involved in property operations, please be sure to verify the identity of the other party first, and please always pay attention to FenXue Technology's tips on preventing fraudulent crimes.
1. The Software may use third-party software or technology (including the Software may use open source code and public domain code, etc., the same below), such use has been legally authorized.
2. If the Software uses third party software or technology, FenXue Technology will display relevant agreements or other documents in the form of "Software License Agreement", "License Agreement", "Open Source Code License" or other forms in accordance with relevant laws and regulations or agreements, which may be packaged in the specific folder of this software installation package through the attachment of this agreement, or through open source software pages. The foregoing agreements, other documents and web pages in any form are an integral part of this Agreement and have the same legal effect as this Agreement, and you shall comply with these requirements. If you do not comply with these requirements, the third party or state authorities may bring a lawsuit, fine or take other sanctions against you and require FenXue Technology to give assistance, you should bear the legal responsibility yourself.
3. Any disputes arising from the Software or technology of the third party used in this software shall be resolved by the third party, and Fenxue Technology shall not assume any responsibility. FenXue Technology does not provide customer service support for third-party software or technology. If you need support, please contact the third party.
1. You agree that FenXue Technology may send you advertising, promotional or publicity information (including commercial and non-commercial information) in the process of providing services by itself or by third-party advertisers, the manner and scope of which may be changed without notice to you. FenXue Technology may provide you with the option to turn off advertising information, but at no time shall you block or filter advertising information in a manner not expressly agreed to in this Agreement or not permitted in writing by FenXue Technology. FenXue Technology shall fulfill relevant obligations to advertisers in accordance with the provisions of the law, and you shall judge the authenticity of advertising information by yourself and be responsible for your own judgment behavior. Except as expressly stipulated by the law, FenXue Technology shall not be responsible for the losses or damages suffered by you due to the transactions conducted according to the advertising information or the contents provided by the aforementioned advertisers. You agree that you should carefully judge the authenticity and reliability of the advertising information appearing in Fenxue Technology Service, and you should be responsible for the transactions based on the advertising information except as expressly provided by law.
2. Some of the Services of FenXue Technology are provided in the form of fees, if you use the paid services, please comply with the relevant agreements. FenXue Technology may modify and change the charging standards and methods of the charging services according to the actual needs, and FenXue Technology may also start charging for some free services. Before the aforementioned modification, change or start charging, FenXue Technology will make a notice or announcement on the corresponding service page. If you do not agree with the above modifications, changes or paid content, you should stop using the service.
1. You understand and agree that in the process of using this service, you may encounter force majeure and other risk factors, which may cause this service to be interrupted. Force majeure refers to the objective events that cannot be foreseen, overcome and avoided and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, plague epidemics and storms, as well as social events such as war, unrest, government actions, etc. In case of the above situation, FenXue Technology will strive to cooperate with the relevant units at the first time to repair in a timely manner, but the losses caused to you by this will be exempted within the scope permitted by law.
2. To the extent permitted by law, FenXue Technology is not responsible for service interruption or obstruction caused by the following circumstances:
(1) destroyed by computer viruses, Trojans or other malicious programs and hackers;
(2) the computer software, system, hardware and communication lines of the user or FenXue Technology fail;
(3) improper operation by the user;
(4) the user uses this service in a way that is not authorized by FenXue Technology;
(5) other circumstances beyond the control of FenXue Technology or reasonably foreseeable.
3. You understand and agree that in the process of using the service, you may encounter risks brought by network information or other user behaviors. Fenxue Technology is not responsible for the authenticity, applicability and legality of any information, nor is it responsible for the damage caused to you by infringement. These risks include, but are not limited to:
(1) information containing threatening, defamatory, objectionable or unlawful content from another person, either anonymously or by impersonation;
(2) any psychological or physical harm, as well as financial loss, suffered by others as a result of misleading, deceptive or otherwise caused or likely to be caused by the use of the Services under this Agreement;
(3) other risks caused by network information or user behavior.
4. You understand and agree that the Services are not designed for certain specific purposes, including but not limited to nuclear facilities, military use, medical facilities, transportation and communication, and other important areas. In case of casualties, property losses and environmental damage caused by the failure of the above operations due to Software or services, Fenxue Technology will not bear legal liability.
5. FenXue Technology has the right to deal with illegal contents according to this Agreement, which does not constitute the obligation or commitment of FenXue Technology, and FenXue Technology cannot guarantee timely detection of illegal acts or corresponding treatment.
6. Under no circumstances should you trust anybody to borrow money, ask for passwords or other network information related to property. If property operation is involved, please verify the identity of the other party first, and always pay attention to the tips on preventing fraud.
1. When you use the services of FenXue Technology, you will be deemed to have read this Agreement and accepted the constraints of this Agreement. FenXue Technology has the right to amend the terms of this agreement when necessary. You can check the latest version of the terms of the agreement in the relevant service page. If you continue to use the Software or services provided by FenXue Technology after the terms of this Agreement have been changed, you are deemed to have accepted the modified Agreement. If you do not accept the modified agreement, you should stop using the Software or services provided by FenXue Technology.
2. FenXue Technology may change the content of the service, and may also interrupt, suspend or terminate the service. You understand and agree that FenXue Technology has the right to determine its own business strategy. In the event of a merger, separation, acquisition, or transfer of assets, FenXue Technology may transfer the relevant assets under the Service to a third party; FenXue Technology may also transfer some or all of the Services under this Agreement to a third party for operation or performance after unilateral notification to you. The specific transferee shall be subject to the notice of Fenxue Technology.
3. In case of any of the following circumstances, FenXue Technology has the right to interrupt or terminate the service provided to you without notice:.
(1) according to the law, you should submit true information, and the personal data you provide is untrue, or inconsistent with the information at the time of registration and fails to provide reasonable proof;
(2) you violate the relevant laws and regulations or the agreement of this Agreement;
(3) in accordance with the provisions of the law or the requirements of the competent authorities.
(4) for security reasons or other necessary circumstances.
4. FenXue technology has the right to charge according to this agreement. If you do not pay in full and on time, FenXue Technology has the right to interrupt, suspend or terminate the provision of services.
5. You are responsible for your own backup of the data stored in the Service. If your service is terminated, FenXue Technology can permanently remove your data from the server, except as otherwise provided by laws and regulations. After the termination of the service, FenXue Technology has no obligation to return the data to you.
1. The establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the Mainland of the People's Republic of China (excluding conflict of laws)
2. This Agreement is signed in Dongcheng District, Beijing, People's Republic of China.
3. If there is any dispute or dispute between you and Fenxue Technology, it should be settled through friendly negotiation first; if consultation fails, you agree to submit the dispute or controversy to the jurisdiction of the people's court of the place where this agreement is signed (i.e. Dongcheng District, Beijing, People's Republic of China).
4. The titles of all the terms of this Agreement are for the convenience of reading only, and have no actual meaning in themselves, and cannot be used as the basis for the interpretation of the meaning of this Agreement.
5. If the terms of this agreement are invalid or unenforceable for whatever reason, the remaining terms are still valid and binding on both parties.
1. If the user is under 18 years of age, he/she is a minor and should read this Agreement and use the Services under the supervision and guidance of a guardian.
2. Minor users are not yet involved in the world, they are easily confused by the virtual image of the network, and curious, lacking the ability to deal with improvisation in case of problems, and easily used by people with ulterior motives and lacking the ability to protect themselves. Therefore, minor users should pay attention to the following matters when using the Service to raise their safety awareness and strengthen self-protection:
(1) recognize the difference between the online world and the real world, and avoid getting addicted to the Internet, which may affect daily study life;
(2) when filling out personal information, strengthen the awareness of personal protection to avoid harassment of personal life by undesirable elements;
(3) learn to use the Internet correctly under the guidance of guardians or teachers;
(4) avoid meeting or participating in casual online activities with unfamiliar people to avoid the possibility of unruly elements taking advantage of them and endangering their safety;
3. Guardians and schools should provide more guidance to minors in using the Services. In particular, parents should care about the growth of their children, pay attention to communication with their children, and instruct them on the safety issues they should pay attention to when using the Internet, so as to prevent problems before they occur.
